In Florida, penalties for a DUI conviction are harsh. First-time offenders face jail time, large fines and mandatory license suspension. As the number of convictions increase, so do the penalties. DUI Conviction Consequences

In Florida, DUI penalties for a conviction are typically as follows:

  • First conviction — Fines up to $1,000, up to six months in jail, mandatory community service and up to one year of probation; mandatory license suspension of 180 days up to one year.
  • Second conviction — Fines up to $2,000 and up to nine months in jail. If the second conviction occurred within five years of the previous offense, your license may be revoked for five years.
  • Third conviction in 10 years — Up to $5,000 in fines, anywhere from 30 days to one year in jail and a mandatory 10-year license revocation.
  • Fourth and subsequent convictions — A minimum of $2,000 in fines and up to five years in prison. In addition, your driver's license may be permanently revoked with no possibility of hardship reinstatement.

A third DUI conviction within 10 years and fourth or fifth DUI convictions are felony-level charges. If an accident occurred resulting in serious bodily injury to another, charges may be elevated to felony level.

Penalties may be increased based on the circumstances. Common enhancements include:

  • Minor in the vehicle
  • High blood alcohol content (BAC)
  • Property damage
  • Injury to a person
  • Hit-and-run/leaving the scene of an accident
  • Vehicular manslaughter
  • Vehicular homicide
