Understanding domestic violence charges

On Behalf of | Jan 10, 2019 | Domestic Violence, Firm News |

Whether it was a fight that stemmed from the busy holiday season or something that has been a relationship issue for some time, fights are fairly common in relationships and families. However, what is not common or acceptable are fights that elevate to physical or threatening altercations. These matters are treated very seriously, and when one alleges a domestic assault occurred, the accused could face serious consequences.

Domestic violence could mean several things. It could include repetitive physical abuse, ongoing psychological abuse or even involve a cycle of violence. The details of the matter are factors when charging the accused with the crime. Common factors include the severity of the injuries suffered by the victim, whether a minor was present and whether a protective or restraining order was violated in the commission of the presumed crime.

Because domestic violence can take many forms, such as physical, sexual, emotional and economic, a proper investigation is needed to determine whether this was occurring. In addition to uncovering the facts involved in the matter, the accused can also find ways to poke holes in the case. In some matters, significant others will lie about domestic violence because of an ongoing divorce. He or she may believe that they will obtain a more favorable result if they can get their ex charged with domestic violence.

No matter the cause of reason, those accused of domestic violence should take the time to fully understand the accusations. This also means exploring criminal defense options, as these charges can carry harsh penalties. By taking action, the accused could help to reduce and even dismiss the charges against them. This could ultimately help clear their name.
