Increased Penalties When Weapons Are Involved

When a weapon is used to commit a crime, charges can be elevated and punishments increased. For example, a simple assault and battery — without a gun or other weapon — is typically a misdemeanor, punishable by up to 60 days in jail, probation and $500 in fines. However, if a gun is used during an assault and battery, the charge will be a felony and result in a mandatory minimum three-year prison sentence and fines up to $5,000.

Florida’s Stand Your Ground Law

Criminal charges — such as aggravated assault and battery, murder and manslaughter — often arise when citizens are forced to use firearms to defend themselves against attack. Under Florida’s stand your ground law, there is no duty to retreat. Individuals who are attacked in public or at their homes have the right to use force — even deadly force — to protect themselves.

If you are attacked, you have the right to defend yourself.
