Florida takes a strong stance on drugs and has strict mandatory sentencing guidelines. The higher the quantity of drugs found in your possession, the longer your mandatory prison sentence.

Possession of less than 20 grams of marijuana is a misdemeanor. If convicted, you face fines up to $1,000 and up to one year in jail. Possession of all other types of controlled substances — even in small amounts and for personal use only — may be charged at the felony level.

Felony drug possession convictions carry harsh penalties. Depending on the type and amount of drug involved, convictions can result in fines up to $10,000 and up to 15 years in prison. Even after serving your time, a felony drug conviction will shadow you for years to come. Drug Diversion Programs

Pretrial diversion programs are similar to probation in that participants must follow a strict set of rules — such as ongoing drug testing, monitoring and reporting — and participate in a drug or substance abuse treatment program. The length of the program is typically six months for misdemeanor offenses and one year for felony-level possession charges. After successfully completing the program, your charges will be dismissed.
