Avoid The Consequences Of A Criminal Conviction

In Florida, identity theft is a felony-level offense. If convicted, you have large fines and long prison sentences. The severity of the penalties increase based on the number of victims, amount of money and value of the property involved.

  • Third-degree felony — Fraudulently obtaining and using an individual’s personal information is punishable by a mandatory minimum of three years in prison, $5,000 in fines and restitution.
  • Second-degree felony — Fraudulently using the identifying information of between 10 and 20 individuals, or theft of property valued at $5,000 or more is punishable by $10,000 in fines, payment of restitution to victims and up to 15 years in prison.
  • First-degree felony — Fraudulently using the information of more than 20 individuals or obtaining property valued at $50,000 or more is punishable by fines up to $10,000, restitution to victims and up to 30 years in prison.
